Capitol Beehive of Activity

The Capitol chambers are dark today, as legislators altered their Caesar Chavez holiday to allow themselves a three-day break with their families. However, things in the Sacramento Capitol have not slowed. Last week Governor Jerry Brown
signed legislation enacting $11.2 billion in budget cuts, while negotiations with Republicans to place tax extensions before the voters continue to run hot and cold. Yet, against the backdrop of the budget, hearings and votes continue, and many pieces of legislation are being amended. 

Amendments

Legislative language, when introduced, rarely matches its final form when it becomes law. Bills are constantly amended through the legislative process. Bill language may be compromised to earn votes or as additional insights are considered. Sometimes, bills are even “gutted and amended.” In this case, the entire contents of a bill is removed to be replaced with something else, sometimes on an entirely different issue. For example, AB 1348 (Mansoor, R-Costa Mesa), originally sought to protect a parent’s right to deny permission for any school-administered psychological tests involving their children. Now, with amendments, the bill has been expanded to return to parents many of the rights that have been whittled away in recent years.

“Gender expression” is a key phrase being amended into many of the anti-bullying and pro-homosexual bills. That term is joining the ever-expanding list of characteristics – actual or perceived – upon which discrimination cannot be based. AB 887 (Atkins, D-San Diego), a 48-page bill, makes sweeping changes to California law, redefining gender to mean “a person’s gender identity and gender expression” and adding “civil rights” protections on the basis of gender identity and gender expression to the Civil Code, the Education Code, the Government Code, the Insurance Code, the Labor Code, and the Penal Code.  AB 887 defines the term “gender expression” as “a person’s gender-related appearance and behavior whether or not stereotypically associated with the person’s assigned sex at birth.” The typical post-modern agenda serves to eradicate terms that suggest absolute truth, even regarding biology, by placing new definitions like “gender expression” into law.
