God Bless Those Justices!

Over seven million Californians received good news yesterday, when the California Supreme Court released its decision regarding whether the proponents of Proposition 8 have authority to defend the will of the people in a court of law. 

The Supreme Court justices were unanimous (7-0), stating that Prop 8’s supporters must have the right to defend an initiative, especially when, in this case, no elected state official - such as California’s governor or attorney general - would defend the state’s constitution or the vote of the state’s citizens.

The opinion of the California Supreme Court had been requested by the Ninth Circuit Court of Appeals. A three-judge panel of the Ninth Circuit will now resume its deliberation of the Perry v. Brown case, considering whether the United States Constitution allows marriage’s definition to be limited to a man/woman relationship. 

In May of 2009, the California Supreme Court upheld the will of the people, ruling that the traditional definition of marriage is constitutional. However, two well-known attorneys and a group of wealthy individuals decided to move the issue into the federal court system, against the counsel of national pro-homosexual groups who believe it is premature to put the question before the current make-up of U.S. Supreme Court justices.

The Perry v. Brown court record is now jam-packed with mind-boggling motions, opinions, orders, and disregard for orders. The Prop 8 Legal Defense team has held true to the integrity of case law and legal precedent, while opponents’ arguments - lacking any legal weight - have relied on emotional claims. 

It is expected that the U.S. Supreme Court will hear an appeal of the lower courts‘ rulings some time in late 2012 or 2013. 

As you know, California Family Council has participated in the Prop 8 battle since its beginning, and yesterday’s decision gives us great hope for ultimate victory at the U.S. Supreme Court. Tens of thousands of people have contributed to the Prop 8 Legal Defense Fund (not affiliated with CFC), yet paying the legal bills for excellent representation has been difficult. Although CFC could use your help, I ask that you also consider supporting this legal battle as it begins its turn toward the long home stretch.
